How Does a Guardianship Matter Proceed Through the Courts?

In any guardianship matter, the person requesting the guardianship will file a Petition with the Court. The court will make a temporary order and then appoint an investigator to report on the specific situation that has brought about the request for guardianship. The court investigator will speak to the parties, the children if appropriate, and any other collateral sources before submitting a report to the parties involved and to the court. In contested cases the Court may appoint an attorney to represent the children and may set the matter for an evidentiary hearing before granting permanent guardianship.

If the case is contested and the parties are unable to resolve it themselves the court is the ultimate decision maker in any guardianship matter.
