Differences Between Chapter 7 and Chapter 13

There are many differences between Chapter 7 and Chapter 13 bankruptcy. Chapter 7 is designed for people who have no ability to pay their debt. A Chapter 13 is for debtors who have a regular income and have the ability to pay at least some of their debt. While you have a constitutional right to file bankruptcy, you must still qualify. See the "Means Test" for Chapter 7 and the "Best Interests" test for Chapter 13.

The type of dischargeable debt under Chapter 7 and Chapter 13 can differ. As a general rule, all debts are dischargeable including credit card debt, medical bills, personal loans, old income taxes, and judgments. Debts that are NOT dischargeable include debts that were incurred as a result of willful and malicious injury to property, family support obligations, student loans, criminal fines and drunk driving judgments.
